Issue

HB 5660: Exempt "Party-in-a-Pouch" from the Bottle Deposit Law

Background

HB 5660 exempts new Party-in-a-Pouch beverage containers from the bottle deposit law, which will result in an increase in the litter finding its way onto our riverbanks, roadsides and beaches.

The Michigan Bottle Bill was a voter-initiated measure designed, and successful, in reducing roadside litter and promoting recycling. HB 5660 would undo that some of that success.

It would allow the new Party-in-a-Pouch drinks an unfair market advantage by bypassing the 10-cent deposit, encouraging other beverage makers to sell their product in similar hard-to-recycle packages, resulting in more overall litter.

Second, by encouraging more use of these pouch containers, this bill will discourage the use of more easily recycled bottles and cans. Even for those containers which are not littered, they will add more volume to Michigan landfills.

Dear Senator,

I oppose HB 5660 because it will litter our streets, riverbanks, beaches and roadsides in pouch beverage containers.

The Michigan bottle deposit law was a voter-initiated measure to reduce litter and encourage the use of recyclable containers. This bill does the opposite.

It discourages the use of recyclable containers by granting an unfair market advantage to non-recyclable containers, rather than requiring beverage makers to package their product in recyclable containers as the Bottle Bill intended.

Second, by removing the deposit requirement, this bill removes an important incentive to ensure that these containers are properly disposed, such as could be accomplished with a comparable litter prevention fee.

HB 5660, however, promotes non-recyclable beverage containers and will increase litter. I oppose this bill and I encourage you to do the same!
